Terms of Service

These Terms of Service (“Terms”) are an agreement between you and TasteRex LLC (“TasteRex”, “we”, “us”) about your use of the TasteRex mobile app, the websites at tasterex.com and business.tasterex.com, and related services (the “Service”).

By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Community Guidelines. If you use the Service for a restaurant, the Restaurant Terms also apply.

Important: Section 20 requires most disputes to be resolved by individual binding arbitration rather than in court, and waives class actions. You can opt out within 30 days. See section 20.

1. Who can use TasteRex

• You must be at least 13 years old. If you are under 18 (or the age of majority where you live), you must have permission from a parent or guardian, who agrees to these Terms on your behalf.
• Alcohol-related content is shown only to users who are 21 or older. You must give your real date of birth.
• You may not use the Service if we have previously banned you, or if you are barred from doing so by law.
• You may have one personal account. Accounts are for individuals, not businesses; restaurants use the restaurant portal.

2. Your account

You are responsible for your account and for keeping your sign-in methods secure. Give accurate information, keep it up to date, and tell us at support@tasterex.com if you think someone has accessed your account without permission.

Usernames must not impersonate anyone, mislead people about who you are, infringe anyone’s rights, or be offensive. We may reclaim or change a username that breaks these rules, or one that is inactive for a long period.

3. Your content

“Your Content” means the ratings, scores, rankings, reviews, photos, lists, group names, comments and other material you post.

You own Your Content. By posting it, you give TasteRex a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, modify (for example, resize or crop), adapt, publish, display, distribute and create derivative works from Your Content to operate, improve, promote and provide the Service. This includes combining your scores into community scores and rankings, showing your ratings to the people you choose, and showing share cards you create.

This licence ends when you delete Your Content or your account, except:

• where Your Content has been included in aggregated scores, statistics or rankings that no longer identify you;
• for copies kept in backups for a limited time (see our Privacy Policy);
• where other people have shared it and it is outside our control; and
• where we must keep it for legal reasons or to enforce these Terms.

We will not sell Your Content or license your photos to third parties for their own advertising without your permission.

You promise that:

• you own Your Content or have permission to post it, including from anyone identifiable in your photos;
• your ratings and reviews reflect your own honest, first-hand experience of the dish; and
• Your Content does not break these Terms, our Community Guidelines or the law.

We don’t endorse Your Content and aren’t responsible for it. We may, but don’t have to, review, hold or remove content.

4. Honest ratings

TasteRex only works if rankings are honest. You agree not to:

• rate a dish you haven’t eaten, or fake a verified dine (for example by spoofing your location or altering photo data);
• rate or review a restaurant you own, work for, are closely related to, or compete with;
• offer, accept or arrange payment, free food, discounts or any other benefit in exchange for a rating, review or ranking, unless it is permitted by our Community Guidelines and clearly disclosed;
• create, buy, sell or use multiple or fake accounts, or coordinate with others to push a dish up or down;
• post ratings written or generated by someone else, including by AI, as your own experience; or
• otherwise manipulate scores, rankings, leaderboards, points, badges or titles.

These rules reflect consumer-protection law, including the U.S. Federal Trade Commission’s rule on fake reviews and testimonials. We may remove ratings and suspend accounts involved in manipulation, and may report serious cases to the authorities.

5. Acceptable use

You agree not to:

• harass, threaten, bully, dox or impersonate anyone, or post hateful, sexually explicit, violent or illegal content;
• post anyone’s personal information without permission;
• post spam, advertising or unrelated links;
• infringe anyone’s intellectual property, privacy or other rights;
• scrape, crawl, copy or harvest data from the Service, or access it by automated means, except through features we provide for that purpose;
• use the Service, or any content from it, to train, fine-tune or evaluate artificial intelligence or machine learning models;
• copy, modify, reverse engineer, decompile or create derivative works of the app, except where the law allows despite this restriction;
• probe, scan or test the vulnerability of the Service, break or get around any security or access control, or interfere with the Service or other users. Good-faith security research reported to legal@tasterex.com before disclosure is welcome;
• upload viruses or harmful code;
• use the Service for any commercial purpose not allowed by these Terms; or
• help anyone else do any of these things.

6. Moderation and enforcement

We use automated tools and human review to enforce these Terms and our Community Guidelines. We may remove or hold content, limit features, issue strikes, or suspend or close accounts. Three strikes within twelve months pauses posting. We will tell you what was removed and why, and you may appeal any decision once, as described in the Community Guidelines.

We may act without notice when necessary to protect users, the Service or the public, or to comply with the law.

7. Points, badges, titles and leaderboards

Points, badges, titles, ranks and leaderboard positions are for fun and recognition. They have no monetary value, can’t be sold, traded or transferred, and can’t be exchanged for money or goods except through a promotion we expressly offer. We may change how they work, and may remove ones earned through activity that breaks these Terms.

8. Restaurant, menu and dietary information

Restaurant listings, menus, dish names, photos, hours and other details come from public sources, from users and from restaurants. See Where menu data comes from. We work to keep them accurate, but we do not guarantee that any listing, menu or dish information is accurate, complete or current. Dishes, prices, hours and ingredients change.

Allergies and dietary needs. Dietary details shown on dishes are supplied by restaurants, not checked by TasteRex, and ratings weighted for dietary needs are other diners’ opinions. Kitchens can change recipes and cross-contamination can happen. Always confirm ingredients and allergens directly with the restaurant before you order. TasteRex is not a source of medical or nutritional advice.

Scores and rankings are opinions of users, not statements of fact by TasteRex.

9. Sponsored content

Restaurants may pay for sponsored placements in search and discovery. Sponsored content is always labelled. It does not change any user’s rankings or any community score.

10. Third-party services

The Service works with services we don’t control, such as Sign in with Apple, Google Sign-In, maps from Apple and Google, and restaurant websites we link to. Your use of them is governed by their own terms and privacy policies, and we are not responsible for them.

11. Our intellectual property

The Service, including its software, design, text, graphics, logos, the TasteRex name and the way we combine data and rankings, is owned by TasteRex or our licensors and protected by law. Subject to these Terms, we give you a personal, revocable, non-exclusive, non-transferable licence to use the app on devices you own or control, for your personal, non-commercial use. You may not use our name, logo or trademarks without our written permission.

Map and place data include information from Overture Maps Foundation and other open data sources, provided under their licences. See Settings → Data sources in the app.

Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.

12. Copyright complaints

We respect intellectual property rights and respond to notices under the U.S. Digital Millennium Copyright Act (DMCA). If you believe content on TasteRex infringes your copyright, send our designated agent a notice containing:

1. your physical or electronic signature;
2. identification of the copyrighted work you claim is infringed;
3. identification of the material you want removed, with enough information for us to find it (such as a link or a screenshot showing the username and dish);
4. your name, address, telephone number and email address;
5. a statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent or the law; and
6. a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorised to act on the owner’s behalf.

If your content was removed after a notice and you believe it was a mistake or misidentification, you may send a counter-notice as the DMCA allows. We terminate the accounts of repeat infringers in appropriate circumstances.

13. Privacy

Our Privacy Policy explains how we handle personal information. By using the Service you acknowledge it.

14. Changes to the Service and these Terms

We are constantly improving TasteRex and may add, change or remove features. We may change these Terms. If a change is material, we will tell you in the app or by email before it takes effect and, where required, ask you to accept it. If you keep using the Service after a change takes effect, you accept the new Terms. If you don’t agree, stop using the Service and delete your account.

15. Ending this agreement

You can stop using the Service and delete your account at any time from Settings → Delete my account (see how to delete your account). We may suspend or end your access if you break these Terms, if we must for legal reasons, or if we stop offering the Service, and will tell you where we reasonably can. Sections 3 (to the extent the licence survives), 7, 8, 11, 16 to 20 and 23 survive the end of this agreement.

16. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, TASTEREX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY RESTAURANT, MENU, DIETARY OR OTHER INFORMATION IS ACCURATE. YOUR DEALINGS WITH RESTAURANTS, INCLUDING ANYTHING YOU EAT, ARE BETWEEN YOU AND THE RESTAURANT.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TASTEREX AND ITS OWNERS, EMPLOYEES, AGENTS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) $100.

Some places don’t allow these exclusions or limits, so some may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

18. Indemnity

If you are a business or use the Service in breach of these Terms, you will defend, indemnify and hold harmless TasteRex and its owners, employees and agents from claims, losses and expenses (including reasonable legal fees) arising from Your Content, your use of the Service or your breach of these Terms or the law.

19. Governing law

These Terms are governed by the laws of the State of Utah and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to section 20, the state and federal courts located in Salt Lake County, Utah have exclusive jurisdiction, and you and we consent to their jurisdiction.

20. Dispute resolution: arbitration and class action waiver

Talk to us first. Most concerns can be resolved quickly. Before starting any claim, you agree to email legal@tasterex.com with a description of the dispute and the relief you want, and to try in good faith to resolve it for 60 days.

Arbitration. If we can’t resolve it, you and TasteRex agree that any dispute arising from or relating to these Terms or the Service will be resolved by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitrator may award the same individual relief a court could. Arbitration will take place in Salt Lake County, Utah, or by video or phone, or another location if the rules require it. For claims under $10,000 that are not frivolous, we will pay the AAA filing, administration and arbitrator fees.

Exceptions. Either of us may (a) bring an individual claim in small claims court, and (b) ask a court to stop infringement or misuse of intellectual property.

Class action waiver. You and TasteRex may bring claims against each other only in an individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding. If this waiver is found unenforceable for a claim, that claim must be decided in court, not arbitration.

Opt out. You can opt out of this section by emailing legal@tasterex.com within 30 days of first accepting these Terms, with your name, your account email and a clear statement that you opt out of arbitration. Opting out won’t affect anything else in these Terms.

21. Apple App Store terms

If you downloaded the app from Apple’s App Store:

• These Terms are between you and TasteRex only, not Apple. TasteRex, not Apple, is solely responsible for the app and its content.
• Your licence to use the app is limited to Apple-branded products you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses or costs due to failure to conform to a warranty are TasteRex’s responsibility, subject to these Terms.
• TasteRex, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
• If a third party claims the app or your use of it infringes their intellectual property, TasteRex, not Apple, is responsible for investigating, defending, settling and discharging the claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

22. Google Play

If you downloaded the app from Google Play, Google is not a party to these Terms and is not responsible for the app.

23. General

These Terms, with the policies they reference, are the entire agreement between you and TasteRex about the Service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn’t a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. We may send you notices in the app or by email; you can send notices to the address below. Neither of us is liable for delays caused by events beyond reasonable control.
